Terms and Conditions for the Orchard Gold Online Berry Competition

1. The Competition opens at 12am on Monday 13th June 2011 and closes at 12am on Friday 30th September 2011 (the Competition Period). All entries must be received during the Competition Period.

2. To be eligible to enter this Competition, participants must fully complete online information using the Orchard Gold website during the Competition Period. Once Ffowcs Williams (FW) has received a fully completed entry, participants will be automatically entered into the draw. Each participant may only enter the Competition once by way of the berry quiz. Participants receive additional chances to win by passing onto a participating friend (the friend must first interact with the Orchard Gold site). In addition they may upload a berry recipe or idea, which then needs to be legitimised by the site administrator in order for the entry to be valid.  Uploaded information may be edited prior to publishing on the Orchard Gold site.   Uploaded information (recipes, participant name) may be used as promotional material, at the discretion of FW.

3. Board members, employees, agents (and agent’s employees) and contractors of the FW and the Immediate families of such persons, are not eligible to enter this Competition or to win prizes. “Immediate Family” of a person means the parents, siblings, children and spouse or partner (whether legal or de facto) of that person.

4. To be eligible for entry, participants must reside in New Zealand and be over 18 years of age. FW reserves the right to require any participant to produce identification and/or proof of age.

5. The winning participant will win receive a Dualit Blender (the Prize). There are only three Prizes available. The Prize is not transferable or convertible for other alternatives and cannot be exchanged for cash. The winning participant will be required to present proof of purchase prior to the Prize being sent.  The actual prizes may vary from the description given in these terms and conditions, and from any image of the prize as depicted in any promotional materials associated with this promotion.  In the event that any Prize becomes unavailable for any reason beyond the FW’s control, FW may substitute a prize (or part of the Prize) of equal or greater value.  All other expenses and costs incurred in connection with the prize (including, without limitation, servicing and repairs) from the date the prize is received, will be the responsibility of the winner. 

6. Random draws from all eligible entries will be made on Wednesday 10th August 2011, Wednesday 14th September 2011 and Wednesday 12th October 2011 in the presence of designated FW personnel.    The final decision in respect of any winning entry will be at the sole discretion of the Managing Director of FW and no correspondence will be entered into. 

7. Participants are responsible for supplying correct contact details. If FW is unable to contact the winning participants within 30 days of the draw date, having made reasonable efforts to do so, the winner’s entry will be declared invalid and FW reserves the right to randomly redraw another winner on the same terms and conditions as the original draw.

8. FW takes no responsibility for loss or damage, either direct or indirect suffered by the winner as part of the Prize.

9. FW reserves the right to disqualify any entrant from tampering with the entry process or attempting to act in a fraudulent or dishonest manner.

10. The winner agrees to be involved in any reasonable promotional activities stipulated by FW, including but not limited to photographs and the publication of the winners name.

11. If this Competition cannot be run as planned for reasons beyond the control of the FW, then FW reserves the right in its sole discretion to cancel this Competition.

12. The personal information provided by each customer in entering this Competition will be held in accordance with the Privacy Act 1993. The personal information will be stored on a database and may be used only by FW for drawing the winner and ongoing promotional activities associated with FW.

13. FW will not sell, disclose or distribute the personal information provided by customers to any person, organisation, agency or other third party. Participants may request access to their information or may request their information be removed from the database by contacting FW.
